Patient Matched Medical Device Agreement

When choosing to be fitted and purchase contact lenses through Innovative Eye Care, you agree to the following terms:

I understand that with the use of any contact lens there is the risk of infection, and that lens hygiene is crucial to minimise this risk, including daily cleaning, NOT using tap water and NOT sleeping in lenses (unless otherwise instructed to do so by your optometrist). I understand that if I follow the lens hygiene and wearing instructions from my optometrist then these risks will be minimised but may still exist and that the Innovative Eye Care optometrists are not liable for any damages that occur.

I understand that the quality of vision and comfort provided by contact lenses may be limited by the lens design, individual ocular parameters and technology available. I understand that the contact lens provided is classified as a custom-made patient-matched medical device under the Australian Regulatory Guidelines for Medical Devices (ARGMD) and carries a risk of side effects. I understand that the medical device is designed from my biometric data and cannot be resold. The optometrist will do their best to resolve the issue or offer an alternative solution but there is no full refund possible if my lens result is unsatisfactory or if lens wear needs to be ceased.

I understand that regular reviews are required to maintain optimum fitting lenses and eye health. I agree to attend annual reviews, or more frequent reviews, as recommended by my optometrist.
